Terms of use
Last updated 15 October 2026
These terms apply to your use of SellPrivate ("we", "us"). By using the site or buying a package you agree to them.
1. Our service
SellPrivate is an advertising and support service for owners selling their own property. We are not a real estate agent, we do not act on your behalf in negotiations, and we do not hold deposits or prepare contracts. Any appraisal report is an estimate to help you set a price and is not a formal valuation.
2. Your listing
- You must be the owner of the property, or authorised by the owner, and the information and photos you provide must be accurate, lawful and yours to use.
- You are responsible for meeting the laws that apply to selling property in your state, including preparing the contract of sale or disclosure documents your state requires before marketing or signing.
- We review every listing and may edit, decline or remove a listing that is inaccurate, misleading, unlawful or breaches these terms or a portal's rules.
- Portals publish listings under their own rules and timeframes. We send your listing promptly, but we can't guarantee how or when a portal displays it.
3. Packages and payment
- Package prices are in Australian dollars and include GST. A package is a one-off fee for a listing of one property until it is sold or withdrawn.
- If we can't approve your listing, we refund your package in full. After your listing has been published to the portals, the package is not refundable, except as required by the Australian Consumer Law.
- Package inclusions such as signs, letterbox cards, photography, floor plans and advertising are provided once per listing.
4. Buyers
Listing information is supplied by owners or, where a listing shows an agency's name, by that licensed agency, which handles enquiries and the sale. Buyers should inspect the property, make their own enquiries and obtain independent legal and financial advice before buying. Never pay a deposit except through a conveyancer, solicitor or other trust account.
5. Liability
Nothing in these terms excludes rights you have under the Australian Consumer Law. To the extent the law allows, our liability for any claim relating to the service is limited to re-supplying the service or refunding the package fee.
6. General
These terms are governed by the laws of New South Wales, Australia. We may update these terms; the version on this page applies from the date shown. Questions? Use our contact form.
